TykeMart strives to create a safe and comfortable environment for our members to interact with each other when buying and selling kids’ and maternity apparel. In order to ensure that all of our members have a pleasant and enjoyable experience on our site we ask members to follow these rules & regulations:

 

A. In The Marketplace:

 

I. Allowed Products Items must fit in the categories of Kids’ and Maternity clothes, accessories, and small goods. Items must be fit in USPS boxes posted in our shipping guidelines.

 

  • clothing
  • footwear
  • hair accessories
  • jewelry and other accessories
  • crib/bassinet/cradle BEDDING (sheets, quits, etc.)
  • baby blankets/towels
  • infant & toddler feeding {nursing pillows, breast pumps, NEW & SEALED pump accessories, NEW & SEALED bottles, pacifiers, Sealed/Unopened Formula and baby food (must still have shelf life/not expired) } Please be mindful of shipping guidelines.
  • Children’s books, CDs, DVDs, video games
  • Toys
  • Pre-owned items can be listed on FlipItBaby as long as they are clean and in good condition. Items used for feeding and nursing with the exception of breast pumps must be New & Sealed (bottles, pacifiers, feeding cups, bowls, and utensils, breast pump accessories, etc.)

 

II. Prohibited Products

 

  • Items that do not fit in the categories of kids’ and maternity clothes, accessories, and small goods
  • Perfume
  • nail polish
  • aerosol products
  • Electronics
  • Furniture
  • large baby gear (cribs, playpens, strollers, any item that will not fit into the described boxes)
  • home goods
  • women’s clothing
  • men’s clothing
  • used makeup
  • used swimsuits
  • all types of used undergarments
  • expired and/or opened containers of baby formula and baby food
  • expired and/or unsealed food products
  • unsealed feeding and nursing accessories
  • firearms
  • tobacco products
  • Alcohol
  • controlled substances
  • health and wellness products that are not FDA approved.
  • Items that may be offensive to some members such as items printed with profane or obscene words or pictures depicting nudity
  • Items that in anyway ridicule or discriminate against members’ race, color, creed, or sexual orientation
  • Items that have been recalled by the manufacturer and/or government safety agencies
  • Items that are counterfeit, fakes, replicas, or inspired
  • Items that are Phony, Damaged, or Falsely Advertised – PDF

 

Items listed for sale that fall into the prohibited categories will be removed from the seller’s closet. Sellers who consistently list prohibited items for sale may be suspended or restricted from the community. TykeMart reserves the right to report persons posting illegal and controlled substances to the appropriate government agency.

 

III. Sellers

 

  • All members must be trustworthy when posting items for sale
  • Sellers must accurately describe and represent items they list for sale. Pictures posted of items must include actual photos of the items showing any flaws or defects; not pictures cut and pasted from catalogues, magazines, or other media sources. {Buyers have the right to return any purchased item that is deemed Phony, Damaged, or Falsely Advertised (PDF). Sellers are required to accept the return and issue a full refund of the purchase price and the original shipping cost of items that are PDF. Seller will also be liable for the return shipping cost. Sellers who consistently disregard TykeMart’s PDF policy may be suspended or restricted from the community}
  • Items posted must be priced at a minimum of $5. If you don’t think an item will sell for the minimum price add another item to it and make it a bundle. Just keep the shipping guidelines in mind when doing so.
  • Business Entities (have a Tax ID Number) MUST submit their Tax ID Number when setting up their TykeMart Closets.
  • Members who are Business Entities will be issued a form 1099 at the end of each calendar year. They are responsible for filing that form with the appropriate government tax agencies.
  • Members who have set up a TykeMart Closet are responsible for filing their earnings with the appropriate government tax agencies. (IRS and State Tax Departments)
  • Sellers must ship items using the pre-paid pre-addressed shipping labels that TykeMart emails to them
  • Sellers are responsible for shipping out their orders in the correct envelope or box. Items must be dropped off at a USPS Mailbox/ Post Office or Sellers may schedule free pick-up by USPS thru www.USPS.com.
  • Members will have to file claims with USPS for any lost or damaged packages. Please read how to file a claim on www.USPS.com. All Priority Flat Rate Shipments include insurance up to $50 Value

 

IV. Buyers

 

  • Buyers are responsible for paying shipping costs on their purchases, they must fit in USPS boxes that are posted in our shipping guidelines.
  • Buyers are responsible for contacting TykeMart within 3 days of an item’s delivery if the item is PDF. claimpdf@ tykemart.com

 

V. Funding & Cash Out

 

  • Funds from all items sold will be placed in the seller’s redeemable balance 3 days after the item has been delivered to the buyer
  • Members may request to cash out once their TykeMart account has accrued a minimum of $25. Email cashout@ tykemart.com to request cash out.
  • Members requesting to cash out may choose to have a check mailed to them or a direct bank deposit made thru Intuit Payment Network; cash outs using either option will be at no cost to the member. Members requesting a check are responsible for providing TykeMart with the correct address and payee at the time the request is made. TykeMart will only send check payments to the name and the address we have on record, be sure to update your Profiles with your current information
  • TykeMart will mail checks via USPS and will not be liable for lost, stolen, or misdirected checks. However TykeMart may re-issue a check payment if the payee reports the original check lost and said check has not be cashed. To report a lost, stolen, or misdirected check email cashout@ tykemart.com, write LOST CHECK in the subject line.
  • Members requesting cash out via IPN must be registered receivers with IPN. They will be responsible for providing TykeMart with their correct email address and acknowledge that IPN will deposit their funds to the receiving bank account they have designated on their IPN account. To register go to https://ipn.intuit.com. It’s easy and free. IPN cash outs will only be sent to the email address we have on file for you, be sure to update your Profiles with your current information
  • Double check and update the email and address information in your profile BEFORE you send a Cash Out Request. Notify us immediately if you have made a mistake cashout@ tykemart.com, Write MISTAKE on the subject line.

 

VI. Returns/Refunds/Disputes

 

  • All transactions made on the TykeMart website are final. TykeMart will not issue any form of refund.
  • TykeMart does not accept returns. {The only time sellers will be required to accept a return will be if an item sold is deemed to be PDF. If an item sold is so deemed Sellers will be liable for issuing buyer a full refund of the purchase price plus the original shipping costs AND the costs of return shipping}
  • Should a dispute arise TykeMart will act as mediator in an effort to resolve the issue to both parties satisfaction. TykeMart will remain impartial and any resolution will be final
  • Should a buyer receive an item that she thinks is PDF she must initiate a claim by emailing ClaimPDF@ tykemart.com within 3 days of the item’s delivery

 

  1. Buyer must state that the item received is PDF.
  2. Buyer must send photos, descriptions, and information of the item she is claiming to be PDF

 

  • TykeMart will assign a Claim Number, notify the seller that the item may fall into the PDF category, and hold the funds from the sale of the item until the claim is resolved
  • Sellers must reply to ClaimPDF@ tykemart.com within 3 days of receiving the notification that a claim has been initiated

 

  1. Seller must include the Claim Number in the response
  2. Seller must send photos, receipts, and any other information needed to dispute the claim

 

  • TykeMart will make the determination on each claim after reviewing information submitted by both parties involved.
  • Buyer and Seller will be notified of the outcome and resolution within 7 days of the initial complaint.

 

  1. Should the item be deemed to be PDF TykeMart will email the buyer a return label so that the item can be returned to the seller.
  2. The seller will be required to pay the return postage as well as refund the purchase price and original shipping cost of the item. The original and return shipping costs will be deducted from the sellers account, the purchase price will be the funds that were held when the claim was filed. Should the seller’s account not have enough balance to cover the original and return shipping costs funds from future sales will be withheld until those costs are paid in full.
  3. Once the item has been received by the seller TykeMart will refund the buyer’s credit card the purchase price and shipping cost that was originally paid.
  4. Should the item be deemed NOT PDF funds from the sale will be placed in the seller’s account and the claim will be closed.

 

  • Buyers who fail to notify TykeMart within 3 days of delivery that the item they received falls into the PDF category must deal directly with the seller. Three days after the item has been delivered TykeMart no longer holds the funds, they have been released to the seller. TykeMark will not issue any refunds on behalf of the seller for any items once the funds have been released to the seller.
  • Sellers who fail to respond to a PDF complaint within 3 days of receiving the PDF notification will be required to refund the purchase price and pay the original and return shipping costs of the item. TykeMart will email the buyer a return label so the item can be returned to the seller. The purchase price and original shipping costs will be refunded to the buyer once the item has been delivered back to the seller. Original and return shipping will be deducted from the seller’s account as detailed above
  • Sellers who consistently disregard TykeMart’s PDF policy may be suspended or restricted from the community.
  • Buyers who abuse TykeMart’s PDF policy by consistently filing false PDF claims may be suspended or restricted from the community.

 

B. In The Community

 

I. Conduct

 

  • Members are required to treat each other with courtesy and respect
  • The use of profanity and insults is inappropriate and is strictly prohibited. Members who leave profane and insulting comments in members’ closets, newsfeeds, and during TykeMart parties will be suspended or restricted from the community.
  • Members may not interfere in any negotiations or transactions between other members. Members who consistently do so will be suspended or restricted from the community.
  • For our members’ protection we do not allow trades between each other. All items or bundles must have a minimum price of $5. Our system will not accept purchase values below $5 at checkout.
  • All transactions involving all items listed on the site must be transacted thru the TykeMart site. Taking these transactions off-site thru PayPal or any other means is strictly prohibited. Members who make off-site transactions as well as members who encourage off-site transactions will be suspended or restricted from the community, there will be no exceptions!
  • Members may not send spam to other members or engage in any type of harassing or annoying behavior anywhere in the community.

 

  • TykeMart provides an end to end platform for its members to buy and sell new and gently worn children’s and maternity apparel; membership is free of charge; members may list their items for sale on the site at no cost. TykeMart will pay all credit card transaction fees, send pre-paid pre-addressed labels to sellers, track shipments, deposit earnings into sellers TykeMart account, and cash out accounts (minimum $25) upon request. In return for these services TykeMart will deduct a 20% commission from the purchase price of every item sold on the TykeMart site.
  • TykeMart strongly discourages sellers from posting photos of children modeling items being sold. If sellers choose to post such photos they must obscure or crop out the children’s faces and remove any location indicators (school name, home address, etc.) from the photo.  For the children’s safety GPS locators must be turned off on the device used to take such photos. Posted photos that show children’s faces and locations may be removed from the site.
  • Members acknowledge that TykeMart does not stock or list any items for sale. All listed items are owned and controlled by each individual member.  Members will not hold TykeMart liable for any misrepresentation of items posted by its members. TykeMart will not be held responsible for any and all errors made by its members or any of its independent contractors contracted to perform certain services such as delayed shipping by USPS.
  • TykeMart is not involved in any negotiations between buyers and sellers and does not guaranty, warranty, or represent any items listed by its members. 
  • TykeMart will not be responsible for refunds sellers will be required to pay buyers if a purchased item is deemed to be (Phony, Damaged, or Falsely Advertised) PDF.
  • Off-site transactions are strictly prohibited. Members who choose to violate this rule do so at their own risk.  TykeMart will not mediate any such transactions nor will it be involved in anyway.  TykeMart is not liable for any transactions that are made off-site using PayPal or any other method
  • TykeMart ships thru USPS.  Members must use the correct boxes that are posted on our shipping guidelines and printed onthe postage paid labels emailed to them.  These can be ordered free of charge from USPS.com
  • TykeMart will not be liable for lost, stolen, or misdirected packages.  Members will have tracking information and can track the packages thru the USPS tracking system.  Sellers will be responsible to file claims with USPS should a shipment be lost, stolen, or damaged.
  • TykeMart will not be liable for any errors made by IPN.  Members are encouraged to read IPN terms & conditions before choosing this option.  Members must be registered receivers with IPN, it is free of charge. Go to ipn.intuit.com to register and read their terms & conditions.  
  • TykeMart will not be liable for taxes on sellers’ earnings. (Earnings are the monies you get from the sale of items listed in your TykeMart Closet AFTER the 20% commission has been deducted.)
  • TykeMart collects and stores certain personal information from members for its own use.  TykeMart will not sell, or distribute any information collected.  See Privacy Policy for complete information.  TykeMart uses the services of independent contractors for shipping, credit card acceptance, and cash out payments who collect personal information from members in order to perform their specific tasks.  Independent contractors have their own Privacy Policy, and Terms & Conditions.  All independent contractors collect member information via their secured sites.  TykeMart will not be liable for errors made by its independent contractors.  Members may review all the policies of its independent contractors.  Contact info@ tykemart.com for a list of current contractors. 

 TykeMart reserves the right to change or amend rules and conditions at any time without notice.
